PRESIDENT MAY BE COMPELLED TO APPOINT LAND COMMISSION
Petition No 6/2013 filed on 9th January 2013 to be heard on Thursday 17th January 2013
Following the haze surrounding the appointment of the national land commission, two petitioners, one from Turkana County and another from Mombasa County, have gone to the High Court, the Constitutional Review and Human Rights Division under a certificate of urgency seeking orders to compel the appointing office to deliver on its constitutional duty. Petition No 6/2013, filed on Wednesday 9th January 2013, will now be heard on Thursday 17th January 2013
Attorney General placed in an awkward legal situation
This new development puts the Attorney General's office in an awkward legal position given his earlier presentations in Court on earlier petitions filed last year. In the earlier petitions, the AG opposed prayers for orders to restrain the president from appointing while he is now faced with a situation seeking mandatory orders that the president be compelled to appoint this commission. Let's see how he navigates this.
